    • To Whom: You can file a First Appeal with the ‘First Appellate Authority’ (FAA) of the concerned Public Authority. Generally, the FAA is an officer senior to the PIO.
    • When: You must file the First Appeal within 30 days from the date on which the PIO ought to have responded (or from the date you received the response, if it was unsatisfactory).
    • In Case of Delay: If you are unable to file the appeal on time due to a reasonable cause, the Appellate Authority may accept your appeal even after 30 days. However, you will need to provide a valid reason for the delay.

    Format and Required Documents for First Appeal

    When filing a First Appeal, you will need some important documents and information:

    • A copy of the original RTI application.
    • Proof of submission of the RTI application (postal receipt, online tracking number, or any other proof).
    • If a partial response was received, a copy of the same.
    • Clearly state the reason for the appeal (e.g., ‘No response received’ or ‘Unsatisfactory response’).
    • A letter addressed to the Appellate Authority clearly stating your request and the grounds for the First Appeal.

    If the First Appeal Also Remains Unanswered or is Unsatisfactory

    If the First Appellate Authority also fails to render a decision within 30 days (or 45 days in special cases), or if you find their decision unsatisfactory, you have the right to file a Second Appeal.

    • To Whom: You can file a Second Appeal with the State Information Commission (SIC) or the Central Information Commission (CIC). This depends on the concerned public authority.
    • When: The Second Appeal must be filed within 90 days from the date of the First Appellate Authority’s decision. If the First Appellate Authority has not given any decision, then 90 days will be counted from the date on which the decision ought to have been given.

    Provisions for Penalty and Compensation

    The Information Commission (State or Central) has the power to take strict action against the PIO if they fail to provide information, delay it, or provide incorrect information without any reasonable cause:

    • Penalty: The Commission can impose a penalty of ₹250 per day on the concerned PIO, which can go up to a maximum of ₹25,000. This penalty is deducted from the PIO’s salary.
    • Compensation: The Commission can also direct the public authority to compensate the applicant for any loss or detriment suffered. This can be significant relief for the applicant.
    • Disciplinary Action: The Commission can also recommend disciplinary action against the PIO.

    Complaint for Delay or Wrong Information

    You can also file a complaint directly with the Information Commission under Section 18 of the RTI Act if:

    • You did not receive the information within the stipulated time.
    • You believe that incorrect, incomplete, or misleading information has been provided.
    • You have been asked to pay an excessive fee.
    • Your application has been rejected.
